By signing up for the Tintwork, you, as a Member, agree to the following:
Tintwork is a referral service providing window tint installation jobs to experienced, professional window tint installers (referred to as “Members” or “tinter”). There is no guarantee of consistent work. Both Tintwork and the Tintwork members can terminate their membership at any time in an email or text; however it is the Member’s obligation to complete the work already assigned or notify Tintwork that the work will need to be reassigned to another member.
There are 2 roles a member can play within the Tintwork: "Tinter" or "Referrer". "Tinter" is the window tint installer hired to do the job. "Referrer" is the member who has an extra job and uses the Tintwork to find a Tinter to do a specific job.
Each member is an independent contractor and not an employee, partner, franchisee or joint-venture of Tintwork. Members are completely responsible for the quality of work that they do and their own taxes. There is no direct employer/employee relationship with any other member of the Tintwork. Tinters are non-exclusive. In other words, Members are able to serve customers outside of the Tintwork. However, NO TINTER OR REFERRER IS ALLOWED TO DIRECTLY CONTACT EACH OTHER OUTSIDE OF THE TINTWORK TO ARRANGE APPOINTMENTS! ALL JOBS NEED TO BE ARRANGED THROUGH THE TINTWORK! If you're dishonest, the Tintwork falls apart.
TERMS OF MEMBERSHIP BETWEEN TINTWORK AND TINTER AND/OR REFERRER

Both the Tintwork and the Tintwork members can terminate their membership at any time in writing; however it is the Member’s obligation to complete the work already assigned or notify Tintwork that the work will need to be reassigned to another member in a timely fashion.
Each member is an independent contractor operating their own window tinting business and not an employee, partner, franchisee or joint-venture of Tintwork. Members are completely responsible for the quality of work that they do, and reporting their own taxes. There is no direct employer/employee relationship with any other member of the Tintwork. Tinters are non-exclusive. In other words, Members are able to seek work with any other company they choose outside of the Tintwork. The Tinter declares that he/she is engaged in an independent business, and has complied and will comply with all federal, state and local laws relating to business permits and licenses of any kind that may be required to carry out the business and tasks to be performed by the Tinter under this agreement. No payment or withholding of any federal, state, local, city or other payroll or employment taxes, including but not limited to FICA, state and federal income taxes, state disability insurance taxes, and state unemployment insurance taxes related to income received by Tinter from the Tintwork will be made. No workers compensation insurance has been or will be obtained by Tintwork on account of the member. Tinters are strongly encouraged to carry their own liability insurance policy. Those members that name Tintwork in the policy for extra coverage will receive priority bookings.
TINTERS AND/OR REFERRERS SHALL INDEMNIFY AND HOLD TINTWORK HARMLESS AGAINST ANY CLAIM FOR INJURIES OR DAMAGES CAUSED BY ANYTHING RELATED TO THE REFERRED WORK.
If installing tint in California, a specialty contractor’s license is only required for commercial and residential work over $500 and not for automotive window tint installation. If you are in another state, please consult that state to any special required licensure.
Member agrees to receive a pre-determined wholesale price for window tinting services performed. Monetary amount charged to customer above and beyond the predetermined wholesale price will go directly to the Tintwork to be divided between the Referrer’s portion and Tintwork’s service fee. Whenever possible, Tintwork will receive those fees direct from the Referrer or customer and the Tinter will receive cash payment of solely their portion due upon completion of the job from the customer. In some cases, the customer will prefer to pay the full amount to the window tint installer upon completion of the job. Tinter agrees to pay Tintwork any portion above what is due to them immediately upon completion of the job. Please see the section regarding the "reserve" to learn more on how that works.
During the term of this membership and for 6 months thereafter, the window tint installer will not attempt to do business with, or otherwise solicit any customers referred to by Tintwork without prior negotiation with Tintwork regarding referral fees due.
All members must agree to honor a Lifetime Warranty on the film they use. If the tint begins to bubble, peel, or any other issues, the Tinter agrees to replace it for no extra charge to the customer within 10 days of complaint unless otherwise negotiated. Tinter is responsible for seeking compensation for the warranty directly from the tint manufacturer they used (if you so choose to do so) If the Tinter fails to fix the problem in a timely fashion, Tintwork will assign another Tinter to fix it for them. The Tinter who fails to fix their own problems in a timely fashion will be charged for the removal and installation of new tint plus a $20 service fee (minimum $60 to tinter + $20 service fee= minimum $80 per issue)
Code of Conduct between Tintwork members and customers:
Tintwork members must agree to the highest standards of ethics and appropriate code of conduct. We are all independent business owners helping each other out so we all need to respect how each member conducts their own business with their own pricing. ONLY THE ONE WHO ORIGINATED THE JOB, THE “REFERRER”, IS ALLOWED TO ALTER THE PRICE CHARGED TO THE CUSTOMER. All Tintwork members must respect this policy and understand that if a Tinter starts charging different prices to a Referrer’s customer, that could jeopardize the integrity of the relationship the Referrer has already established with that customer. If there is any change or addition to the order, Tinter must contact Tintwork immediately. Tinter is never authorized to negotiate prices with the customer directly without verbal or written consent from Tintwork. Tintwork will make every effort to contact Referrer immediately so the Referrer can make the necessary adjustments to the pricing directly with the customer. However, if Tintwork cannot reach the Referrer within 10 minutes, Tintwork is authorized to determine a price alteration. Tinter is never authorized to change the pricing for a job with the customer directly. Tinter already agreed to do the job for the established wholesale price ahead of time. The only exception to this rule deals with removal. As you all know, occasionally tint is much harder to remove than normal. In the rare instance where the tint is extremely difficult and will take double the time than average, Tinter must call Tintwork before getting too far into the job, so we can give the Referrer the option to negotiate a higher price with the customer. If the customer accepts a higher price, Tintwork will change the order to reflect a higher compensation to the Tinter. However, if the Tinter does not have the proper tools to remove film efficiently, that is the Tinter’s fault and he/she cannot ask for more compensation. Tinter is never allowed to "upsell" or "solicit" additional services to the customer. If the customer asks the Tinter about any additional products or services above and beyond the original order, the Tinter is required to ask the customer to contact the Referrer directly for more information. Tinter agrees never to visibly carry a weapon in front of customers. Tinter agrees to always act in a professional, respectful way towards customers. When customers are paying electronically, there will be a note in the "Extra information" section of the job in the app. Tinter is responsible to confirming with the Tintwork office that we have received electronic payment before ending the job in the app and before leaving the jobsite. This is for several reasons but the 2 most common are: Sometimes the customer has trouble sending electronic payment and has to switch to handing you cash in person. In some rare occasions, a customer will be dishonest and refuse to pay after the Tinter leaves. So to protect Tinters, Referrers, and Tintwork, it is the Tinter's responsibility to ensure we have received electronic payment or Tinter has received cash payment before leaving the jobsite and ending the job in the app. If customer refuses to pay, then the Tinter will remove the film before leaving to ensure they don't get a "free" tint job and noone will receive any compensation. If Tinter fails to do so and Tintwork is unsuccessful collecting payment from customer, Tinter will be responsible for the full amount due from the customer.
Handling customer complaints:
If the customer complains about the quality of the tint job, the tinter is responsible for redoing the job to customer's satisfaction, paying another Tintwork member to redo it for them (minimum $80), or refund customer's money (plus service & referral fees). If the tinter accidentally breaks, cuts, burns, or damages any part of the car or building, the tinter is responsible for repairs. Tintwork Members will hold harmless Tintwork from any claims and/or litigation arising out of Tinter’s services provided. The Tinter agrees to indemnify and hold Tintwork harmless should a claim related to expenses, insurance or the lack thereof and/or local, state or federal taxes be made by anyone, including any governmental authority.
If a member gets a large amount of complaints from customers, they may be immediately removed from the Tintwork membership. Mistakes happen, but they should not happen that often and the tinter must do everything they can to fix their mistakes. If no effort is made to fix the mistake, that is grounds for immediate removal from the Tintwork. Even if the tinter is removed from the membership, the tinter is still responsible for the cost of repairs. If a tinter cannot fix his/her mistakes, the tinter must pay another Tintwork member to reinstall the tint or refund the customer the full amount paid he/she paid for the services plus the service fees due to Tintwork and the Referrer’s portion they lost. Member’s agree to accept the final decision made by Tintwork in these cases. If a party fails to perform any of its obligations under this agreement or if dispute arises concerning the meaning of any provision of this agreement, then the defaulting party or the party not prevailing in such dispute, as the case may be, shall pay the reasonable costs and expenses incurred by the other party in enforcing or establishing its rights hereunder, including court costs and reasonable attorney’s fees.
Reserve:
Every tinter is required to keep a minimum $200 reserve. Think of it as a security deposit that will be used for a couple things:
1. Customer complaints. If a customer complains about the work you've done or they are requesting a repair under warranty, you have 2 choices: You can fix the problem within 10 days of the complaint, or pay someone else to do it. If you pay someone else to do it, you will be required to not only pay the wholesale rate to tint the car, but also any removal fees necessary, plus a $20 Tintwork service fee. $80 minimum. Tintwork will draw the appropriate amount from your reserve for that work.
2. While we make every effort to have the customer only hand you cash for the amount due to you, that doesn't always happen. If the customer gives you the full order amount in cash, then Tintwork will pull the amount due to them out of your reserve. You cannot do another job until you have replenished your reserve back up to $200 (minimum). To avoid missing jobs, we highly recommend you set up an electronic payment account with PayPal, Venmo, Zelle, or CASH app. With a click of a button, your reserve will always be met. You could also keep a higher amount in your reserve to prevent any disruptions in membership.
Tintwork may require you to keep a higher reserve if you have customer complaints that have not been resolved yet or if they discover your work is too flawed and there is a high potential for customer complaints to come in. If you fail to confirm with the Tintwork office that we have received electronic payment before you leave a job and the customer refuses to pay after making at least 2 attempts to collect, the entire amount due from the customer will be taken from your reserve. You will become responsible for collecting payment directly from the customer.
Your reserve will be held for 4 months after your membership is terminated in writing to allow time for potential complaints to come in.

TINTWORK TERMS AND CONDITIONS ARE SUBJECT TO CHANGE AT ANY TIME AND FOR ANY REASON. MEMBER WILL BE OBLIGATED TO BE AWARE AND TO COMPLY WITH SAID CHANGES.
Privacy Policy
This policy describes how Tintwork and its affiliates collects and uses personal information to provide our services. This policy applies to all users of our apps, websites, and features. This policy specifically applies to:
Tinters: users who install the tint on customer’s cars or buildings.
Referrer’s: users who book the jobs and provide the customer’s information for the jobs.
This policy also applies to those who provide information to Tintwork in connection with an application to use our services.
The practices described in this policy are subject to applicable laws in the places in which we operate. This means that we only engage in the practices described in this policy in a particular country or region if permitted under the laws of those places. Please contact us if you have questions on our practices in your country or region.
Data collections and usage
The following information is collected by or on behalf of Tintwork:
Information you provide
This may include:
User profile: We collect information when you create or update your Tintwork account. This may include your name, email, phone number, login name and password, address, payment or banking information (including related payment verification information), government identification numbers such as Social Security number, driver’s license or passport if required by law, birth date, photo and signature. This also includes the preferences and settings that you enable for your Tintwork account.
Demographic data: We may collect demographic information about you, including through user surveys. In some countries, we may also receive demographic information about you from third parties.
User content: We may collect information that you submit when you contact Tintwork customer support, provide ratings or compliments for other users, or otherwise contact Tintwork.
Information created when you use our services

Location Information
Depending on the Tintwork services that you use, and your app settings or device permissions, we may collect your precise or approximate location information as determined through data such as GPS, IP address and WiFi.
Tintwork collects location information when the Tintwork app is running in the foreground (app open and on-screen) or background (app open but not on screen) of your device depending on the settings you choose.
Transaction Information
We collect transaction details related to your use of our services, including the type of services you requested or provided, your order details, installation information, date and time the service was provided, amount charged, distance traveled, and payment method.
Usage information
We collect information about how you interact with our services. This includes information such as access dates and times, app features or pages viewed, app crashes and other system activity.
Device Information
We may collect information about the devices you use to access our services, including the hardware models, device IP address, operating systems and versions, software, file names and versions, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion information, and mobile network information.
Communications data
We enable users to communicate with customers through the Tintwork apps. For example, we enable Tinters and customers to call or text each other. To provide this service, Tintwork receives some information regarding the calls or texts, including the date and time of the call/text, and the content of the communications. Tintwork may also use this information for customer support services (including to resolve disputes between users), for safety and security purposes, to improve our products and services and for analytics.

Information Retention And Deletion
Tintwork requires user profile information in order to provide its services, and retains such information for as long you maintain your Tintwork account.

Once such information is no longer necessary to provide Tintwork's services, enable customer support, enhance the user experience or other operational purposes, Tintwork takes steps to prevent access to or use of such information for any purpose other than compliance with these requirements or for purposes of safety, security and fraud prevention and detection.
Tintwork may also retain certain information if necessary for its legitimate business interests, such as fraud prevention and enhancing users' safety and security. For example, if Tintwork shuts down a user's account because of unsafe behavior or security incidents, Tintwork may retain certain information about that account to prevent that user from opening a new Tintwork account in the future.
We may occasionally update this policy. If we make significant changes, we will notify you of the changes through the Tintwork apps or through others means, such as email. To the extent permitted under applicable law, by using our services after such notice, you consent to our updates to this policy.

Tinters: users who install the tint on customer’s cars or buildings.
Referrer’s: users who book the jobs and provide the customer’s information for the jobs.
This policy also applies to those who provide information to Tintwork in connection with an application to use our services.
